Legal terms for using the FireGuard 112+ mobile application

This End User License Agreement (“Agreement”) is a legal agreement between you (“User”) and Chris Zaikis regarding the use of the FireGuard mobile application (“App”).

1. Acceptance of Agreement

By downloading, installing, accessing, or using the FireGuard 112+ mobile application (“App”), you (“User”) agree to be bound by this End User License Agreement (“Agreement”). If you do not agree to this Agreement, you must not use the App and must uninstall it immediately. FireGuard 112+ reserves all rights not expressly granted in this Agreement.

2. License Grant

FireGuard 112+ grants you a limited, revocable, non-exclusive, non transferable, and non sublicensable license to download, install, and use the App solely for your personal, non commercial use on any device you own or control. You may not use the App for commercial, governmental, or emergency response deployment without explicit written permission from the owner.

All rights, title, and interest in the App including but not limited to code, design, text, algorithms, APIs, data structures, graphics, images, logos, trademarks, and documentation are and remain the exclusive property of Chris Zaikis. The App is protected under EU Copyright Law, the Berne Convention, international intellectual property treaties, and applicable national laws. “FireGuard™” and “112+ Emergency Profile™” are trademarks owned by Chris Zaikis. All rights reserved.

Use of the App is also governed by the FireGuard 112+ Privacy Policy, which explains what data is collected, how it is used, how it is stored, and your rights as a user. The Privacy Policy forms an integral part of this Agreement.

6. Third-Party Services

The App may interact with trusted third party services such as NASA FIRMS (Fire Information for Resource Management System), OpenWeather API, Google Play Services, and device operating system frameworks. Each third party may have its own privacy policy and terms. FireGuard is not responsible for the content, operation, or data practices of third-party services.

7. Safety and Disclaimer

FireGuard 112+ provides informational and advisory content only. It does not replace emergency services, professional fire authorities, local weather bureaus, or civil protection guidance. The User remains fully responsible for safety decisions.

The App is provided “as is” and “as available” without warranty of any kind, including but not limited to accuracy, availability, reliability, security, or fitness for a particular purpose. Data sources may vary, be delayed, or become unavailable.

8. Limitation of Liability

To the maximum extent permitted by law, FireGuard, its owner, and its contributors shall not be liable for any personal injury, property damage, loss of data, inaccurate alerts, service interruptions, or any indirect, incidental, special, or consequential damages arising from or related to your use of the App. Your use of the App is entirely at your own risk.

9. Termination

FireGuard 112+ may, at its sole discretion, suspend or terminate your license to use the App if you violate this Agreement, misuse the App, pose a security or legal risk, or where required by law or regulatory authorities. Upon termination, you must immediately uninstall the App and cease all use.

10. Updates and Modifications

We may update the App or this Agreement from time to time. Continued use of the App after any changes to this Agreement constitutes your acceptance of the updated terms.

11. App Store Terms

If the App is downloaded via Google Play or Apple App Store, you acknowledge that this Agreement is between you and the developer only, and not with Google or Apple. Google and Apple have no responsibility for the App or its content, including but not limited to maintenance, support, legal compliance, warranties, or intellectual property claims.

12. Jurisdiction

This Agreement and any disputes arising from or related to the use of the App shall be governed by the laws applicable in the User’s country of residence within the European Union, together with relevant European Union regulations. Jurisdiction for any dispute shall lie with the competent courts of the EU Member State in which the User resides, unless otherwise required by mandatory consumer protection laws or applicable international regulations. Nothing in this Agreement limits any consumer rights granted under the laws of the European Union or the national legislation of EU Member States.

13. Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
